– Answer #OCAPodcast questions – OCA Podcast Patreon – Anime Collector Patreon – StealthWeeb.com – Vic Mignogna Court Case ∟The appeals court received Vic’s documents on the 22nd ∟Officially, they can rule on the case as soon as they want but at least 3 months is likely ∟Nick Rekieta has submitted an amicus brief on behalf of Vic Mignogna
An amicus curiae, in this case Nick Rekieta, is someone who is not a party to a case who assists the court by offering information, expertise, or insight that has a bearing on the issues in the case. The decision on whether or not to consider an amicus brief lies entirely within the discretion of the court.
I wouldn't personally expect the court to consider his brief at all but it would sure be interesting to see whether or not the great swarms of lawyers from Law Twitter that the defendants have constantly claimed as experts pointing to the frivolous nature of the lawsuit were to all submit their own amicus briefs.
Im case you were wondering, "Amicus Curiae" translates from Latin as "friend of the court".
The arsonist had been undergoing skin graft treatment for third-degree burns, but due to the lack of supply of donor skin for treatment – which was prioritized for the victims – he was given an experimental treatment with artificial skin.
Kyoto police obtained a warrant for the arsonist's arrest back in October but were waiting until he was able to withstand detention to formally arrest him. Due to the lack of facilities in the Kyoto Police Detention Center, and the pandemic closing the Osaka Police Detention Center after an outbreak of the virus among staff, police in both prefectures were hesitant to formally arrest him.
As of yesterday, the arsonist has now finally been formally arrested.
Kyoto Animation issued the following statement: “In regards to the accused, we have no additional comment. All that matters is his actions and their results. Regardless of how he may try to excuse his actions, or what remorse he may speak of after the fact, our friends whose lives were taken will not come back, nor will it help the wounds of our injured friends heal. Bereaved families and friends now have to face a permanently changed reality, as must we [at Kyoto Animation]. As a company, we obviously agree with prosecutors pursuing the maximum culpability that the law will allow.” During the first interview with investigators, the arsonist reiterated statements attributed to him at the time of the arson. “I had a grudge against Kyo Ani,” he told investigators. He also admitted that “I thought that if I sprayed gasoline around the building while setting the fire, I could kill more people, so that’s why I did that.” Most stomach-churning of all, though, was his reaction to learning just how many lives he took. When informed that 36 people died either in the attack or due to injuries sustained in it, and that another 33 survivors suffered serious injuries, he responded with “Oh, is that so?” (“Sou nan desu ka?”). As the first official interview since the attack, he had been unaware of just how many people had perished. “I thought maybe about two people died” he told the investigators.

KyoAni's CEO had expressed interest in turning the site into a park and erecting a monument but the neighborhood association submitted a written request specifically asking that the site not be used for any sort of memorial saying:
“If large numbers of people are continually visiting the site, it will destroy our peaceful lifestyle.”
KyoAni President promises upcoming anime movies are still in production, but says “Things are still very far from normal.”
Of the 33 remaining survivors, 27 have already returned to work.
Three employees who returned to work temporarily have since decided they need more time to cope with the stress and anxiety brought about by the attack.
Kyoto Animation as a whole shut down operations for nearly a month at the start of August. The company is continually coordinating with medical institutions to try to provide necessary mental health care and emotional support to its staff, though even with these efforts, a handful of employees have resigned in the aftermath of the incident.
The non-profit Animation for Next Industrial Innovation Conference (ANIC) and the Japan Animation Creators Association (JAniCA) have finished their crowdfunding campaign on Makuake for the victims of the Kyoto Animation arson attack, raising over ¥5.7 Million.
In total, donations to the company have reached over US$26.8 million.
Instead of a previously planned fan event, the studio will hold a "Memorial and Joining-Our-Prayers Service" at the Miyako Messe event hall in Kyoto on November 3-4. The event will be held from 10:00 a.m. to 5:00 p.m. on both days, and admission will be free.
Staying committed to their promise that none of the donations will go to rebuilding the business, the president said that the “best way to rebuild is to look after the families involved.”
Japan's Fire and Disaster Management Agency will be requiring petrol stations and other sellers to check customer IDs and ask them how they will use the fuel.
The arsonist is no longer bedridden, and is able to sit up in a wheelchair. He’s also regained the ability to speak, and can engage in simple conversations with hospital staff, although he is yet to make any mention of the arson attack.
“Kyoto Animation will not be applying any of the money it received from donors around the world for business recovery, but will be using all of it for the bereaved, the injured, and their families.
The company itself will not retain any of the financial support, including funds coming from government institutions, and will move forward under its own power.”
Apparently the victims in the hospital weren't all out of the woods yet as another one has reportedly died.
Instead of the KyoAni and Do Fan Days event on November 3-4, KyoAni will instead create a place inside the city of Kyoto during that weekend where fans can go to "say their farewells to creators to whom they felt a strong connection through their works."
Violet Evergarden: Eternity and the Auto Memories Doll has been extended again beyond 4 weeks now. 4th week theatergoers will receive a small shikishi and theatergoers in the 5th week will receive short stories previously offered during the 1st-3rd weeks.
The rest of the hospitalized victims are no longer in "life-threatening" condition, though many are still in intensive care.
The arsonist is likely to stay hospitalized for several more months.
According to the Kyoto Shimbun, many of the families previously said by the police to have denied consent told the newspaper that they had not denied consent and one family had even been requesting that the names be released.
The Violet Evergarden The Movie's January 2020 release has been delayed.
The separate side-story film, Violet Evergarden: Eternity and the Auto Memories Doll, opened in theaters in Japan on Friday. It was originally planned to screen for only two weeks but will now run for three weeks.
At the strong request from the director of the film, Haruka Fujita, every single staff member was listed in the credits including staff with less than a full year's worth of experience at KyoAni. Presumably the names of the victims are also included.
The condition of the arsonist has been changed to stable but he is still unable to communicate verbally.
Some idiot has threatened Visual Arts with a KyoAni-style attack.
Japanese news outlets are pressuring the police to release the names of the rest of the victims.
KyoAni has dismantled the memorial in front of Studio 1.
The Japanese Government will now be treating the donations to Kyoto Animation as “disaster relief” rather than revenue and so they are offering a tax break to both the donators and the studio.
The arsonist had submitted several novels to KyoAni's contests.
The arsonist's arrest warrant has been updated to include 35 counts of murder, 35 counts of attempted murder, arson of an inhabited structure, as well as a number of other criminal offenses.
However, people are debating whether the arsonist will be spared the death penalty due to mental illness.
This year's Kyoto Animation novel-writing contest is being suspended indefinitely.
Likewise, this year's Enjoy! The World Of KyoAni And Do event is looking like it will likely be canceled as well.
It turns out that lots of animation materials were housed in a location separate from Studio 1 and are being displayed in an exhibit. The exhibition was planned prior to the arson attack but the materials were sent afterward.
"An unprecedented atrocity has robbed many of our friends and colleagues of their bright futures and has left many deeply injured. News from all over the world tells us that amazingly many number of people has sent us their hearts and prayers, which are like candles in the darkness, for those of us trapped in the darkness of deepest grief.
There are many friends and colleagues who are hospitalized and suffering, fighting for their lives. Please give us some time.
We promise that Kyoto Animation will continue to create animation that help people have dreams, hope and impress them. Kyoto animation will continue to make its employees and staff lead happy lives, and contribute to society and local community. I assure you that Kyoto Animation will not give up, we will not go quietly into the night…we will not vanish without a fight!"
– Kyoto Animation Co. CEO Hideaki Hatta KyoAni’s attorney said they have confirmed that the company DID receive a novel for their light novel contest from a person with the same name as the arsonist, and from an address that matches that of the suspect’s apartment.
He went on to say that the novel was formally eliminated from the contest in the first round of the judges’ evaluations. “We have confirmed that it has no similarity to any Kyoto Animation works,” he added.
Since setting up their dedicated bank account for donations, KyoAni has received over $10.8 Million USD from over 50,000 donors with 10 Million Yen ($92,600 USD) coming directly from X Japan frontman, Yoshiki. But KyoAni's attorney has estimated that between financial support for surviving family members, medical support for injured survivors, and company-related business operation recovery expenses, the total cost could be as high as $94 Million USD.
There are a number of regulatory issues to deal with in handling such large sums of money, and the attorney says that KyoAni may establish a special foundation to oversee the administration of the funds, in order to navigate Japan’s laws regarding compensation to victims of crimes and work-related deaths and injuries.
Chief Cabinet Secretary Yoshihide Suga has also called upon relevant government organizations, such as the Ministry of Economy, Trade and Industry, to provide Kyoto Animation with the support it needs in this difficult time. He stated that a nonpartisan, all-party diet group has proposed support measures for the victims and the company. The proposal includes suggestions of tax breaks for donations, and providing support for animator training.

At the time, he was a second-year student at Tohoka University. Tohoka University posted a statement on Friday confirming that a graduate of the school's modeling program died in the fire. Omura graduated from the university in March.
Yuka Kasama. Kasama was only 22 years old. Kasama loved to draw as a child, and from high school wanted to study art at university. Kasama's dream was to enter the animation industry. Kasama was a graduate of Osaka Seikei University.
Yasuhiro Takemoto, director of Lucky Star, Miss Kobayashi's Dragon Maid, Full Metal Panic (Fumoffu & Second Raid), Clannad, Haruhi Suzumiya (series & Disappearance), and Nichijou has been confirmed dead.
Naomi Ishida, color designer for The Disappearance of Haruhi Suzumiya, A Silent Voice, and Liz and the Blue Bird has also been confirmed dead. Tragically, her parents believed she normally worked at Kyoto Animation's 2nd Studio building and presumed she was alive until they couldn't get a hold of her.
KyoAni Studio 1's server was isolated in a separate room completely surrounded by concrete on the building's first floor. Therefore, the server was protected from both the fire and the water used in firefighting efforts and miraculously ALL the data on the server has been recovered without damage!
Yoshiki's statement:
“I’ve held concerts around the globe, and in every country I perform in, many animation fans come to my shows and support my music. I am truly grateful to them. I also want to do what I can to support the artform of Japanese animation, which is a treasure in our world and a form of cultural development.
My heart aches as I think of the pain of those who lost family members. I hope my actions can be of some small comfort to the people who have been affected by this tragedy, and I hope that others will continue to do so too.”

The money raised will be going to the victims and their families to help them with any costs, and will be used for the reconstruction of the company.
The lawyer representing Kyoto Animation tweeted out a statement clarifying what was lost. He said that "although all the paper-based material that was in Studio 1 is gone, not all of KyoAni's paper-based material and data were in Studio 1 at the time." He concluded the tweet by saying that they "are investigating the possibilities of recovering the data from the first studio." Though he didn't say whether this would be through back-up of the servers in the studio or other means.
At the time of the fire, the company's current announced projects were: a new anime project for Sound! Euphonium, a new Violet Evergarden episode and film, an all-new Free! film, a second season for Miss Kobayashi's Dragon Maid, an adaptation of Hiro Yuki's 20 Seiki Denki Mokuroku novel, and the Baja no Studio: Baja no Mita Umi anime short.
The Violet Evergarden Gaiden spin-off movie was completed, and will still premiere at Germany's AnimagiC convention on August 2-4. However, projects that were still in production are almost certainly lost: the main Violet Evergarden movie and the TV series for 20 Seiki Denki Mokuroku would likely need to be restarted almost entirely, or will be cancelled. The new Free! movie was confirmed cancelled. All art and equipment were destroyed in the inferno, however, it is possible that some elements survived in partner and assisting studios but whether any of those elements can be re-used with a new staff is unclear. Works that were already published have master files and artwork in the hands of distribution partners and publishers around the world, and are safe, although countless elements from their production that were housed in the KyoAni building are also gone. Projects from other anime studios that Kyoto Animation may have been assisting with may also experience some delays.
Of the 15 people who are seriously injured, some have yet to regain consciousness, and some are in serious condition. At least one victim had to have their legs amputated due to the injuries and another has died in the hospital bringing the total death count to 35 so far.
The police have confirmed the identities of everyone who died in the fire through DNA testing. KyoAni has announced that they do not plan on releasing the names of victims until after their funerals.
The staff members from Studio 1 that were able to escape the building, many by leaping from the second story windows, returned to work on July 24. Not even a full week since the incident on the 18th.
KyoAni Studio 1 was not only in compliance with all fire codes, they were awarded in 2014 with a certificate of commendation by the fire department for their fire safety compliance. Tragically, the door to the roof was not actually locked. But it had an unusual two-lever mechanism that could be difficult to operate for those who’d never used it before.
The arson attack has prompted call for stricter gas sale regulations in Kyoto though it is abundantly clear that none of the proposed regulations would have stopped the attack.
Japan’s most prominent cosmetic surgeon, Katsuya Takasu, has offered free treatment for Kyoto Animation arson burn victims. Too bad he's a holocaust denying Neo-Nazi.
"My biggest concern with AX is that the con is getting bigger each year to the point where the Los Angeles Convention Center will get way too crowded. I think AX either needs to set up a cap, or relocate AX to a bigger convention center."
I am so incredibly sorry for the delays. I appreciate you sending a follow up so this was brought to my attention. I see your response with the 5 bullet points and I would love to address those now.
1) Our policy is to open and inspect every package that is shipped to us before we complete the mail out. This is because we have to search for prohibited items that are inevitably going to be shipped. Whether that is on purpose or on accident, we cannot be having illegal and prohibited items being shipped as that can seriously hurt and shut down our business completely. I mean, check out the news regarding MyUS.com. They were knowingly falsifying customs and shipping prohibited items, and got fined over $10 million for that. As a business, that is just not acceptable. There are many laws and regulations from each carrier and each country that do prohibit us from shipping certain items. Legally, we have to comply. Sadly, South Africa prohibits sexually explicit materials.
2) Our mail out team in each warehouse are the employees who decide whether an item can ship or not. No, not each person is specialized in every single product, as that is impossible. But we do have a very thorough training process and documents given so they can verify if items can ship or not. As I stated before, we cannot ship sexually explicit items internationally. It just cannot happen due to rules and regulations. In the past, we use to not be able to even ship them within the US, but due to recent changes, we now can ship those items domestically.
4) No, we do not send videos or photos of us disposing of packages. Once you ask for an item to be disposed, it is placed into our dispose pile to be disposed on our weekly trash cycles. Unfortunately, if you choose to return a package, there are fees associated with that.
5) Unfortunately, we have to check every single package before it mails out for legal reasons. You'd be surprised how many people inaccurately declare their items to get away form paying fees, and get prohibited items to ship internationally. At Shipito, we are in the business of honest work, while following all laws, so we check every package. There is no need to feel insecure with this process as it's only to ensure the safety of your package and anyone who may be in contact with it. It is a quick process that is done with every package to avoid fines, planes blowing up, returns, seized packages, etc. Thank you for your patience and understanding in this matter. Please let me know if you have any additional questions or concerns.
Dear Backers,
We here at Rayark thank you for your firm support and for sticking with us throughout this lengthy process. The IZD animated movie was unable to be completed by 2018. We sincerely apologize to our backers and have compiled a Collector's Edition Package, including the complete shooting script, production art, and an IZD hoodie and T-shirt designed around the battle suit. A digital rewards package containing the Implosion game OST, Implosion: Obelisk comic books (Currently completed issues) and Collector Edition Wallpaper, will accompany these packages. Please refer to the detailed rewards list at the end of this announcement to see eligibility requirements based on backer level. All deliveries will take place in March 2019.
We know that waiting longer than expected for our production is hard on our backers, and to show our gratitude, we would like to offer optional refunds to any backers who wish to opt-out at this time. Any backers who choose this option will still receive all of the Collector's Edition rewards they are eligible for, based on their tier. For example, all backers of “Warmech II Pilot” and above will be eligible for a complete Collector's Edition Package in March 2019, regardless of requesting a refund or not, whereas lower tiers will receive their assigned items as shown in the attached rewards list.
Rayark wishes to release only the highest quality products to our fans, and we believe our games and products speak to this, loudly. It is with great determination we face the demands of creating a feature animated film, and the process of mixing technologies to deliver a world-class movie has taken far longer than anticipated. We will not give up and will continue on until we have attained the final quality our fans expect from us. This may take some time but as a community of artists, producers, game-designers and movie-fans ourselves, we will stick together and push on until we have created something we are proud to show you. As of this moment, despite our amazing settings, production animation and overall designs, we have not reached our Rayark quality standard and will continue to revise all elements in IZD until it is worthy of you and the world stage.
We will notify all our backers (regardless of pledge level) via email about the details of the first-wave Collector's Edition rewards and the optional refund information. First-wave rewards schedule is as follows:
January 2019: Email backers to inform them about the first wave of pledge merchandise and the details of the optional refund.
February 2019: Collect shipping information from backers and organize refunds for those who request them. (We will still send you the first wave of pledge merchandise even if you request a refund.)
March 2019: Ship the first wave of merchandise, provide the virtual rewards for download, process refunds.
After the movie is complete: Ship the complete list of pledge rewards to backers who have continued to support us.
If you have any questions about the explanation above, please contact us via service@rayark.com. We wish to express our deepest gratitude to all backers for the patience and support.
Hello,
We’re writing to let you know of an update that may impact you. After January 31st, the ability to automatically post YouTube activity (uploads, liked videos, etc.) on Twitter and Google+ will no longer be available. We’ve found that sharing these actions with a custom message (instead of through automatically generated posts) provides a better experience for the sharer and their followers on other social networks.
You can continue to easily share videos to your social network. Here’s how:
On the watch page on any device: click Share, then click on the social network icon.

While we didn't anticipate beforehand that so many fans would be so passionate about including an English dub for the Phantom Trigger anime adaptation, we certainly heard those voices, and have been exploring multiple options for making it happen, and what amount we would need to set a stretch goal at. Unfortunately, despite reaching out directly to a number of US-based English anime distributors, most have not responded to our outreach. We will of course continue to explore all angles ourselves, but we encourage anyone and everyone interested in an English dub to reach out yourselves and recommend the Phantom Trigger anime adaptation for licensing - a strong community voice may be just what we need to make things happen.
Hello Backers, I sincerely apologize for the lack of updates. We are working on the Kimagure Orange Road Kickstarter and expect to finish that project by the end of January. Once we finish that project, we will be dedicating our time to Kodomo no Jikan. Right now, we are set to release Kodomo no Jikan omnibus vol. 1 digitally to our backers by next Friday (August 10). It is a little nudge forward but soon you will own a digital copy of the first omnibus. A week after backers have received their digital copy, we will publish it on the eManga store at eManga.com. (Omnibus vol. 1 will be print-ready as well) Despite what you hear, we are still working on publishing manga and more importantly, working on kickstarters. I appreciate your patience throughout this process. And by looking through the comments, I noticed a lot of comments regarding updates(lack thereof). While I am always disheartened to update little to no progress, I will try my best to post updates on small details and things of that nature. Please note that I am also in charge of a department here at DMI but if you message us via Kickstarter, I will respond to you and answer to the best of my capabilities.
We have a few more things in the works that we hope to unveil over the next week or so, including another new reward, some add-on items, and more! We also want to let everyone know that we are very seriously investigating the potential of making an English dub of the show a stretch goal, and are currently in discussions with a few companies to see how feasible that is, so expect more news on that soon as well! Thank you to everyone who's shown their support so far, and to anyone who will in the future - we're relying on your help to make this happen!
We've got a big update for you: ARIA The ANIMATION is now officially at verification! That means replication will be happening very soon.
Here's what this means for you:
1) When we submit the replication order, we need to know the final amount of discs to make. That means ARIA The ANIMATION (Season 1) will be REMOVED FROM THE SLACKER BACKER OPTIONS on August 6th at 11:59PM Central Time. If you have been waiting to put in a slacker backer order for season 1, do it ASAP!
Please note, the rest of the seasons and the Guidebook will still be available for purchase. When those items get closer to release, we'll give a cutoff date for them as well.
2) We can't give an exact season 1 release date, since the time it takes to replicate a set can vary. But as soon as the season 1 sets are received into our warehouse, they will be shipping out to US backers. You will receive a shipping notice when that happens, along with an estimated delivery date. So, consider this the last call: if you need to update your shipping information, please do so now! This link will take you where you need to go: https://www.rightstufanime.com/contact-us
INTERNATIONAL BACKERS: The initial plan was that all items for international backers (including tier rewards) would ship in a single shipment once all ARIA seasons were complete. However, we have received requests to do partial shipments by season, and are currently investigating the possibility for those who are interested (although there will be an additional shipping charge). We'll keep you posted as we figure out the details.
It is Okamoto.
Dear Backers,
Today, I have to make a regrettable report.
Completion of the animation will be delayed.
As we reported last time, it is due to lack of personnel.
I judged that further time is necessary to keep quality in it.
The new prospect of completion of the work is in September, 2018.
And the shipment of rewards will be later.
I am really sorry for Buckers who is looking forward to the work.
And I am keenly aware that I am immature.
I will continue to put one's heart into this project.
Best regards,
MECHA-UDE's Director

Hello [NAME REDACTED],
Thank you for voicing your concerns about the recent Re: Zero release.
We’ve heard from a handful of people that there may be issues with this release. We used the approved materials from the licensor under their direction, however based on what we're hearing from our fans, we’re continuing to further investigate this issue.
Our fans and their feedback are important to us and we want to make sure you have the best anime experience possible—thank you again for bringing this to our attention.
Thank You!

Hello Kimagure Orange Road Backers,
It is with my deepest apologies that you have waited so long for this Kickstarter but we have finally come around to begin the shipping process.
Shipping:
Shipping out items will begin NEXT WEEK, sometime between Wednesday and Friday.
This will take some time as we 1) have limited staff on hand and 2) can only complete so many at one time given our financial situation (Refer to our previous update). It will be a slow process but a process we are committed to finishing.
This may frustrate many backers but the only way to begin this shipping process is to begin with the lower tiers ($) and work our way up to the higher tiers ($$$). We currently have the shipping supplies to ship out the lower tiers. Lower tier items are also easier to ship. With the higher tiers, we need to compile specific shipping supplies and make sure all the items are securely packed. This ensures that no backer receives damaged goods.
With that begin said, please respond to your surveys as we will send them out by tier. (You should receive a notification when we send out a survey to your specific tier.) We will give backers a week to submit their surveys. If you complete your survey late, the only consequence is that your goods will arrive later rather than sooner. Right now, we sent out a survey to the EARLY BIRD SUMMER tier.
Again, I am sorry for the delay and right now, our priority is to send out these packages.
I will be handling customer service from here on out. I will only answer on this platform as it will keep the line of communication organized. To people who previously messaged us and never received a message, I will try my best to get around to answering your questions and/or concerns.
Sincerely,

As some of you may know, we are beginning to ship out the items for our oldest incomplete KickStarter "Kimagure Orange Road." As stated in the update for that KS, we will slowly ship items out to their backers.
As for this KickStarter, Kodomo No Jikan, we will make faster progress once we've completed KOR's shipping.
Here is what we still need to do:
Translations: Translations are complete except for the jokes. A new person is deciphering these puns and double entendres as we speak.
We have yet to order the slipcases.
Key Chains are not complete.
The over-all book production (preparing it for print and digital) is notcomplete.
I do intend to give you updates as we check off things once they're completed :) Please message us if you have any questions and we will do our best to answer them.
Dear eBay Seller,
eBay supports tax policy that is fair to entrepreneurs, artisans and small businesses and opposes efforts to impose taxes that are harmful to sellers like you, who are vital to the American economy. For all the small business sellers that use eBay there has never been a more critical time to stand against new and unfair Internet taxes.
The U.S. Supreme Court will make a decision in the coming weeks that could give states the right to tax every small business on the Internet. The issue is just as pressing on Capitol Hill. States, shopping center owners, and giant retailers are lobbying hard to increase taxes on small business owners like you, and everyone who buys from you online. When the Supreme Court makes its decision, it will bring together the various threads on the issue of Internet sales tax.
Our leaders in Washington, D.C. and in state capitals across America need to know how you feel about new Internet tax burdens – burdens that could negatively impact your ability to sell online in a variety of ways.
The link below takes you to a petition we plan to deliver to President Trump, key members of Congress, and select state governors. Please digitally sign the petition today. It will take you less than three minutes and help us tell political leaders that you stand with us against these new taxes. Feel free to encourage your networks to also sign the petition.
Rest assured that eBay will continue to fight this battle on your behalf!
Sincerely,
Scott Cutler
